New legal rights to sue for environmental NGOs in Germany

The author of this legal comment describes the two legislative acts the German legislature passed to implement the second and third pillar of the Aarhus Convention. He analyses the new provisions, compares them to the requirements of European Community Directive 2003/35 and the Aarhus Convention and comes to the conclusion that the new legislative acts do not properly implement the EC Directive and the Aarhus Convention.
