Council of Europe: Baseline study of legislation, policy and judicial practice on human rights and environment in South-East Europe

This baseline study by the Council of Europe highlights the negative impact of environmental harms on human rights in South-East Europe and emphasizes the need for a human rights framework to support environmental protection. It reviews domestic legislation, judicial practices, and policies in six jurisdictions seeking accession to the European Union, identifying common challenges such as pollution, environmental crime, and restricted public participation. The study offers recommendations for stronger legal frameworks, better implementation, and enhanced public awareness, aiming to harmonize laws and improve environmental and human rights outcomes across the region. The findings and recommendations are also relevant beyond South-East Europe, advocating for a coordinated response and peer-to-peer learning.
