Scotland: Draft court rules against prohibitively expensive costs

New court rules relating to the protective expenses orders (PEOs) were recently drafted and published for public consultation by the Scottish Civil Justice Council. The aim of the rules is to prevent legal costs from being prohibitively expensive, an obligation stipulated under the Aarhus Convention and EU Law. Previous rules had been determined insufficient to get into compliance with the Convention despite several amendments.
