Germany: Another unsuccessful legal action

The Bavarian Administrative Court (VGH) has rejected a claim brought by the “Land Association for the Protection of Birds” arguing that the planned construction of a windmill would endanger the life of rare birds in the region. The Court’s rejection of the claim was based on the argument that members of the association were not personally affected by the project. However, the right of associations to bring an action against environmental degradation is actually granted by the Aarhus Convention. The association is allowed to appeal the decision but it is not yet clear whether it will seize this opportunity.
