The council ratifies submission of appeal against oil exploration in the Canaries

These violations affect both the Spanish legislation such as the European and, in the event that the remedy of appeal is not addressed, will lead new judicial and administrative actions in both areas.

Reasons for objection to such authorization the following listed:

Reasons direct challenge:

1.1. Violation of the rights to information, participation and protection of legitimate interests of citizens and Canarian institutions, and the interested public.

In the office of the Director General for Energy Policy and Mines, Jaime Suárez Pérez Lucas on14 June 2014 did not revealed instruction process to stakeholders. Hence, there was a breach of the Article 84.1 of Law 30/1992.

Under the secretary of Industry, Energy and Tourism, Enrique Hernández Bento, told reporters that the intended audience is a "mere formality" so that none of these potential claims have important effects.

The Minister Jose Manuel Soria Lopez, sent a statement to the media and reiterating that environmental impact assessment of the project submitted by Repsol 'will not stop surveys authorized in Canary'.

These attitudes constitute a breach of Article 84 of Law 30/1992 and Articles 1 and 6 of the Aarhus Convention of 1998 and Articles 6 and 8 of Directive 2011/92.
