BVerwG: Proceedings of the BUND against expansion of a major power plant in Mannheim unsuccessful

The joined as a party operates in Mannheim on the north bank of the Rhine, a coal-fired power plant, which will be extended by another block with a thermal capacity of 2100 MW. North and northeast of the power plant site, commercial and industrial areas is enclosed. A development plan for the power plant site does not exist. The attacked the permit assumes that the requirements are met with regard to air pollution to protect the public.


The Federal Administrative Court rejected the appeal of the BUND. Environmental organizations can claim the class action only violation of legislation in the interest of environmental protection. The right to a Full range testing in a permit decision can be derived either from the Aarhus Convention nor from the public participation policy. The environmental impact assessment was allowed as well as the immission based solely on the extension project. The additional burden of the project moves within the Irrelevanzschwellen the TA Luft which are compatible with higher-ranking law. Finally the project without preparation of a development plan has been approved. Any planning obligation could not be held against the approval.
