The article presents a legal precedent for rights of environmental organizations which is an important milestone in the general improvement of environmental law protection and the implementation of the Aarhus Convention in Austria. It was decided that for the construction of a large biomass district heating power plant in Klagenfurt an Environmental Impact Assessment (EIA) must be carried out.
