UK: Lord Justice suggests extending Aarhus Rules to all Judicial Review Claims

A judge from the Court of Appeal of England and Wales reviewed the costs of civil litigation in the UK. In his report, Lord Justice Jackson recommends to adapt the “Aarhus Rules” and extend them to all judicial review claims. The Aarhus Rules are based on the Aarhus Convention and limit recoverable costs in environmental cases. This article looks at this proposal and what has changed since this recommendation was made for the first time in 2009.
