Spain: The TSJC dismisses the appeal against the Energy Sustainability Plan of Cantabria

The Administrative Chamber of Cantabria’s Supreme Court (TSJC) has dismissed the claim brought before it by the Platform for the Defence of the Valley of Southern Cantabria against the Sustainable Energy Plan of Cantabria (CFSP) 2014-2020, which regulates the regional energy model. The ruling is in line with the position of the Government of Cantabria, which held that it was not in violation with the law during the process of public consultation on the regulations. The Court stated that at no point in time, significant or non-significant modifications have been introduced, which have not been subject to public inquiry. Similarly, it considers that there is no breach of the Aarhus Convention on public participation in environmental matters since the association’s questions have been fully answered in three public participation procedures.
